GBKH Partner Testifies against Bill Granting Legal Immunity to Insurance Industry

On March 31st, GBKH Partner Mark Kincaid appeared before the Texas Senate’s Committee on Business & Commerce to testify against Senate Bill 1628. Introduced by Senator Larry Taylor (R-Friendswood), SB 1628 proposes sweeping changes to the state’s insurance code. Within its language is a provision giving insurance adjusters total immunity from legal actions filed by Texas policyholders, a clause barring policyholders from recovering any damages caused by unfair claim denials, and a measure threatening prosecution of policyholders for making innocent mistakes in claim amounts. Mark testified that the bill’s attempts to rewrite existing law are unprecedented, unnecessary, and unfair, and argued that it would turn insurance adjusters and insurance companies into “a unique special interest group in the State of Texas that is immune from any accountability.”
