GBKH Partner Testifies against Bill Granting Legal Immunity to Insurance Industry

On March 31st, GBKH Partner Mark Kincaid appeared before the Texas Senate’s Committee on Business & Commerce to testify against Senate Bill 1628. Introduced by Senator Larry Taylor (R-Friendswood), SB 1628 proposes sweeping changes to the state’s insurance code. Within its language is a provision giving insurance adjusters total immunity from legal actions filed by Texas policyholders, a clause barring policyholders from recovering any damages caused by unfair claim denials, and a measure threatening prosecution of policyholders for making innocent mistakes in claim amounts. … read more


GBKH Partner to Argue Case before Supreme Court of the United States

On March 23, 2015, GBKH Partner Jim George will argue a First Amendment case before the Supreme Court of the United States on behalf of the Texas Chapter of the Sons of Confederate Veterans. At issue is whether the State of Texas may regulate the content of certain speech, which in this case involves the denial of an application for an automobile license plate bearing the Confederate battle flag. Austin Court of Appeals Upholds Dismissal of $100 Million Bond Validation Suit

In a victory for the San Antonio Water System (SAWS), GBKH succeeded in obtaining an order from the Austin Court of Appeals upholding a lower court’s dismissal of a $100 million bond validation suit brought by the Guadalupe Blanco River Authority (GBRA). The suit sought approval of a bond issue under the Texas Expedited Declaratory Judgment Act, but the broader relief sought by GBRA would have curtailed SAWS’s water rights. The Court of Appeals held that the relief sought by GBRA exceeded the scope of the statute. GBKH Partner Argues False Claims Act Case at Fifth Circuit Court of Appeals

On March 3, 2015, GBKH Partner Jim George argued for affirmance of the dismissal of a False Claims Act case brought against his clients, Davis S.R. Aviation, LLC, d/b/a Challenger Spares and Support, Challenger Repair Group, LLC, and Steve Davis. The plaintiff, George Gage, sued GBKH’ clients, Northrop Grumman Corp., Bombardier, Inc., and Orion Air Group, LLC, claiming various improprieties in the salvage and sale of aircraft parts to the federal government. GBKH Files New Case against Lance Armstrong

On October 7th, GBKH partners Jim George, Mark Kincaid, and Russ Horton filed a legal action against cyclist Lance Armstrong, demanding more than $1 million in damages for Fireman’s Fund Insurance Company and The IMA Financial Group. In 1999, the two firms covered a significant portion of a $2 million bonus that the owner of Armstrong’s team paid the athlete in connection with his first Tour de France win. Armstrong admitted in 2013 to having used performance-enhancing drugs in that race and those that followed, and the International Cycling Union has since stripped him of all seven of his Tour de France titles.
